FAQs About Real Estate Law

Absolutely.  Buying or selling a home is a complex process and there can be severe consequences for the buyer or seller if not done properly.   A buyer or seller is wise to have an attorney review and revise the purchase and sale contract to best protect their interests, advise on title issues, prepare and review the closing documents, and offer legal guidance on any number of the intricate issues that commonly arise during a transaction.

A real estate attorney will prepare or review the Offer to Purchase and the Purchase and Sale Agreement to best protect your interests.

Work with real estate brokers to help ensure deadlines are met and a smooth transaction results.

Review the title to the property to address any title defects, mortgages, liens, or other matters than can delay or impede your transaction.

Record documents with the Registry of Deeds that affect your title to the property.

Advise you on title insurance, homestead protections, trust and probate matters, real estate taxes, home inspection issues, document preparation, contract terms and amendments, and many other common issues that may arise throughout your transaction.

Coordinate with the lender’s closing attorney.  Frequently the Buyer’s attorney may also act as the lender’s closing attorney which is often advantageous and can make your transaction smoother and more efficient.
